As the owner of the property, you are obliged to request the energy certificate and give it to the notary during or before the transfer of the property.
It is also mandatory that the energy label is mentioned in the advertisement or on the website of the estate agent where the house is offered for sale.
WHO CAN MAKE THE ENERGY CERTIFICATE FOR YOU?
The energy efficiency certificate is issued by a technician which is normally an architect, engineer or structural engineer who is qualified to carry out construction projects as required by current regulations.

WHICH BUILDINGS DO NOT NEED AN ENERGY CERTIFICATE?
- Football stadiums, bullfighting arenas, in short all buildings without a fixed roof
- Officially protected buildings and monuments.
- Buildings used for religious activities
- Temporary constructions with an expected duration of use of 2 years or less
- Industrial and agricultural buildings
- Insulated buildings with a total useful floor area of less than 50 m2. (Apartments or terraced houses with less than 50m2 are mandatory).
- Buildings of technical simplicity not having a residential character.
- Buildings bought for demolition
- Buildings that are rented for less than four months a year
BUT ... WHAT IS THE ENERGY CERTIFICATE?
The energy certificate is an official document to be created and drawn up by a competent, qualified and accredited technician, containing all the necessary information to assess the energy performance of a building.
The purpose of this document is to qualify all the elements that determine the energy consumption and insulation of a building, country house, village house, flat, business premises, etc.
WHAT ELEMENTS ARE EVALUATED IN AN ENERGY CERTIFICATE?
Everything that uses energy: boiler, heating, air conditioning, appliances and the consumption of various types of energy sources such as solar panels, electricity, gas, firewood, etc.
In addition to the energy label with the qualification of the property, the energy saving certificate includes a report with technical specifications and recommendations to improve the energy performance of the house or building.
In addition to the energy label, the certificate contains various annexes, including:
- Technical information about the property
- Explanation of the assigned energy label
- Recommendations to improve energy efficiency
And, as a final step, the homeowner must submit a copy of the certificate signed by a qualified technician to the Junta de Andalucía's energy efficiency certificate registration. However, the technician can be authorised by the owner to present the report on their behalf.
WHAT IS THE ENERGY CERTIFICATE AND HOW SHOULD I INTERPRET IT?
On the first page of the energy certificate, the energy label is the visual representation of the assessment obtained for the rational and efficient use of energy of the dwelling.
This assessment is presented in scales from A to G. The highest score, i.e. A, corresponds to the best possible energy performance. The letter G, opposite, corresponds to the worse energy performance.
In addition, the energy label contains information about energy consumption and carbon dioxide production.
Validity of the certificate is 10 years.
AM I IN VIOLATION IF I WANT TO SELL MY HOUSE WITHOUT A CERTIFICATE?
Yes. The violations can be light, serious or very serious and the fines can be between 300 and 6000 euros. For example, it is a violation of the law to advertise the sale or rental of a house without mentioning the energy efficiency rating.
